Xenth AI is the trade name under which DERIAN ANDRE CASTILLO FRANCO, a self-employed individual with business activity, operates as the controller responsible for the processing of your personal data. Personal data we collect

We collect the data you provide us directly when you write to us on WhatsApp, by email, or through any contact form: name, contact details (phone, email), your company's name, and any information you choose to share about your processes and operation when requesting a quote or diagnosis.

When you browse the site, technical browsing data is also collected: IP address, browser and device type, pages visited, referring site, and interactions such as clicks. Analytics and marketing cookie identifiers are only created if you accept them, as explained in the cookies section. We do not collect sensitive personal data or financial or asset data through this site.

Purposes of the processing

Primary purposes, necessary for the relationship you request and without which we cannot serve you: identifying and contacting you, answering your inquiries, preparing quotes and proposals, providing the consulting and automation services you hire, and complying with the tax and legal obligations that relationship creates.

Secondary purposes, not indispensable but that let us serve you better: sending you information about new Xenth AI services or content related to what you already inquired about; measuring how the site is used in order to improve it (analytics); and measuring the effectiveness of our campaigns and showing you Xenth AI ads on other platforms (marketing). You may deny your consent to these secondary purposes at any time, without affecting the primary services: for communications, by writing to hola@xenth.ai with the subject "Opt out of communications"; for analytics and marketing, from "Cookie preferences" in the footer.

Legal basis for the processing

The processing of your data for the primary purposes is based on the legal or pre-contractual relationship created when you contact us or hire a service. The processing for secondary purposes, including analytics and marketing cookies, is based on your consent, which you may revoke as described in this notice.

ARCO rights

You have the right to Access your personal data, to Rectify it if inaccurate, to Cancel it when you consider it no longer necessary for the stated purposes, and to Object to its processing for specific purposes.

To exercise any of these rights, write to hola@xenth.ai from the email address through which you have a relationship with us. Your request must include: your full name, the right you wish to exercise, a clear and precise description of the personal data involved, and any document that helps locate your data. We will respond within a maximum of 20 business days from receiving your request, and if it applies, we will act on it within the following 15 business days.

Revoking consent and limiting use or disclosure

You may revoke any consent you have given us for the processing of your data, and request that we limit its use or disclosure, by writing to hola@xenth.ai following the same procedure and timelines described for ARCO rights. You may withdraw your consent to analytics and marketing cookies at any time from "Cookie preferences" in the footer of every page; the change applies immediately.

Cookies and tracking technologies

This site uses Google Tag Manager to load the following technologies, grouped by purpose.

Necessary: your browser's local storage keeps your cookie choice. It does not identify you and does not require consent.

Analytics, only with your consent: Google Analytics 4, to learn which pages are visited and which actions are taken on the site.

Marketing, only with your consent: Google Ads, Meta Pixel, LinkedIn Insight Tag, and TikTok Pixel, to measure the results of our campaigns and show you Xenth AI ads on those platforms.

Until you accept, none of these tools sets cookies. With Google we use its consent mode: before you decide, Google receives cookieless signals (that a page was viewed and your consent state, along with the connection's technical data, such as the IP address), which it uses to estimate results in aggregate. We ask you again every six months, or sooner if the tools described here change. You can change your choice at any time from "Cookie preferences" in the footer, and you can also delete or block cookies from your browser's settings.

Data transfers

The following third parties take part in operating the site and the tools described, and may process browsing data outside Mexico: Cloudflare, Inc., which hosts the site and has no access to the data you share with us through WhatsApp or email; Google LLC (Google Tag Manager, Google Analytics, and Google Ads); Meta Platforms, Inc. (Meta Pixel); LinkedIn Corporation (LinkedIn Insight Tag); and TikTok (TikTok Pixel). The analytics and marketing tools only receive cookie-linked data if you consent. Beyond these cases, we do not transfer your personal data to any third party, except where a competent authority requires it by law.

Changes to this notice

Any modification to this privacy notice will be published on this same page, showing the new last-updated date. We recommend reviewing it periodically if you maintain an ongoing relationship with Xenth AI.
