Terms and conditions
These terms govern the use of this site and the hiring of the AI consulting and process automation services Xenth AI offers. By using the site or hiring a service, you accept what is described here.
Who provides the service
Xenth AI is the trade name under which DERIAN ANDRE CASTILLO FRANCO, a self-employed individual with business activity (RESICO tax regime), provides artificial intelligence consulting and process automation services. It is not a company name or a commercial corporation.
Purpose
These terms apply both to the informational use of this site and to hiring the services described on it: process mapping, automation ecosystem design, integrations with n8n and custom APIs, document generation, training, and ongoing support.
Scope of services and prior quote
No publication on this site — including reference prices — constitutes a binding offer or a contract. The scope, deliverables, timeline, and final price of each project are set in writing in a specific quote or proposal before any work begins, and that quote governs the relationship between the parties.
Intellectual property
The content of this site (text, design, the Xenth AI brand, and graphic elements) belongs to DERIAN ANDRE CASTILLO FRANCO and may not be reproduced without authorization.
Regarding project deliverables: once the corresponding payment is settled, ownership of the client-specific deliverables (automation flows configured for their operation, documents generated to their specification, documentation of their process) is transferred to the client as agreed in the quote. Xenth AI retains ownership of the knowledge, methodology, base templates, reusable components, and know-how used to build them, none of which is exclusive to any client.
Confidentiality
Each client's operational information, processes, data, and systems are treated as confidential and used only to provide the contracted service. Xenth AI does not share that information with third parties or use it as a case study without the client's express authorization.
Limitation of liability
Artificial intelligence systems can produce incorrect or incomplete results. Any AI-generated output in Xenth AI's projects requires human review before being used in an operational decision, and Xenth AI is not responsible for decisions made without that review.
The content of this site and Xenth AI's services do not constitute legal, tax, financial, or medical advice, and do not replace the opinion of a certified professional in those fields.
Payments, invoicing, and cancellations
Payment schemes (for example 50/50 or 30/40/30) are defined in each quote based on the length of the project. All fees are invoiced under current Mexican tax regulations (CFDI), in the name of the individual or entity requesting the service. Cancellation or refund terms for a project in progress are set out in the corresponding quote; absent a different agreement, work already delivered and stages already paid are non-refundable.
Term and modifications
These terms apply for as long as the site is available. Xenth AI may update them at any time; the version in force is the one published on this page with its last-updated date. A project already under contract is governed by the terms in force on the date the accepted quote was signed, unless otherwise agreed in writing.
Governing law and jurisdiction
These terms are governed by the laws of the United Mexican States. For any dispute related to them, the parties submit to the competent courts of the city of Querétaro, Querétaro, expressly waiving any other jurisdiction that might correspond to them by reason of their present or future domicile.
